Terms of Service

1. Acceptance of Terms

By accessing or using the Rud1 platform (“Service”) operated by Rud1 (“we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not access or use the Service.

If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms, and references to “you” include that organisation.

2. Service Description

Rud1 is a cloud platform for remote device management. The Service enables you to monitor and control IoT hardware (including Raspberry-Pi-based gateways, PLCs, and industrial devices) via managed WireGuard VPN tunnels, USB-over-IP streaming, 4G failover, OTA firmware updates, telemetry dashboards, and alert rules.

Features and pricing tiers are described at rud1.es/#pricing and may change over time with reasonable notice.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your credentials and API keys.
  • All activity that occurs under your account, whether authorised by you or not.
  • Promptly notifying us at support@rud1.es if you suspect unauthorised access.
  • Keeping your contact information accurate and up to date.

You must be at least 18 years old and legally capable of entering a contract to use the Service.

4. Acceptable Use

You may not use the Service to:

  • Violate any applicable law or regulation, including export control laws.
  • Transmit malware, viruses, or any malicious code.
  • Attempt to gain unauthorised access to any system, network, or data.
  • Resell, redistribute, or sublicense access to the Service without prior written consent.
  • Engage in excessive API usage that degrades Service performance for other users.
  • Use the Service to control devices without the knowledge and consent of the device owner.

We reserve the right to suspend or terminate accounts that violate this policy without prior notice.

5. Service Availability

We aim to provide a reliable Service but do not guarantee uninterrupted availability. No SLA is offered on the free plan. We may perform scheduled or emergency maintenance that temporarily affects availability.

Paid plans may include uptime commitments as specified in the applicable plan description. In any case, our maximum liability for downtime is limited to a credit against future fees as described in Section 9.

6. Payments & Billing

Paid features are not yet available. When billing is introduced:

  • Subscription fees will be charged in advance on a monthly or annual basis.
  • All prices are shown exclusive of applicable taxes (e.g., VAT).
  • You authorise us to charge your payment method on file for all applicable fees.
  • Refunds are not provided for partial months; cancellation takes effect at the end of the current billing period.

We will give at least 30 days’ notice before introducing paid features currently offered for free.

7. Intellectual Property

The Service, including all software, design, trademarks, and documentation, is owned by Rud1 and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to access and use the Service as permitted by these Terms.

You retain all ownership of data you submit to the Service (device telemetry, configuration, etc.). You grant us a licence to process that data solely for the purpose of providing the Service to you.

8. Termination

You may terminate your account at any time from the Settings page or by contacting us. We may suspend or terminate your access immediately if you breach these Terms, or with 30 days’ notice for any other reason.

Upon termination, your right to use the Service ceases. We will delete your data in accordance with our Privacy Policy. Provisions that by their nature should survive (IP rights, limitation of liability, governing law) will remain in effect.

9. Limitation of Liability

To the maximum extent permitted by law, Rud1 and its affiliates shall not be liable for:

  • Indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service.
  • Loss of data, profits, goodwill, or business opportunities.
  • Damages resulting from unauthorised access to or alteration of your transmissions or data.

Our total aggregate liability to you shall not exceed the greater of (a) the fees paid by you to Rud1 in the 12 months prior to the event giving rise to the claim, or (b) €100.

10. Changes to Terms

We may update these Terms at any time. If the changes are material we will notify you by email at least 14 days before they take effect. By continuing to use the Service after the effective date, you accept the revised Terms.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of Spain. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Spain, without regard to conflict-of-law principles.

Consumers residing in EU member states retain the right to bring proceedings in the courts of their country of residence.
